Air Control Pilates® Ground School Terms and Conditions (“TERMS”)

IF YOU ACCESS THIS ONLINE LEARNING PLATFORM, YOU ARE AGREEING TO THESE TERMS, OUR PRIVACY POLICY AND/OR ANY OF THE PARTS OF THESE TERMS.
We reserve the right to change these Terms of Service or to impose new conditions on use of the online learning platform, from time to time, in which case we will post the revised Terms of Service on our online learning platform. By continuing to use our online learning platform after we post any such changes, you accept the Terms of Service, as modified. If you do not agree, please discontinue using our online learning platform immediately. We are more than happy to answer any questions you have about our policies. Definitions
“Air Control Pilates” means Air Control Pilates Limited, Company number SC530057 having its registered office at Office Block, Dalhousie Business Park, Carrington Road, Bonnyrigg, EH19 3HY, UK Contact Telephone Number: + 44 7957 679334
“Contract” means the contract between Air Control Pilates Ltd and the Learner for the supply of Services in accordance with these Terms and Conditions.
“Learner” (including references to You and Your) means the person or firm who purchases the Services from Air Control Pilates Ltd.
“Services” means the services provided in relation to the Air Control Pilates® Ground School course(s) supplied by Air Control Pilates to the Learner.
Bookings & Payments
All Ground School course bookings must be completed online via our online learning platform; teachable. Booking is only confirmed and course access granted once successful payment has been made.
Course Prerequisites
There are no specific prerequisites for our theoretical Ground School courses. A minimum level of health & fitness is assumed when partaking in our online Pilates matwork classes. Please see Appendix 1 (below) for further details.
Certification
Upon successful completion of the theoretical courses within Ground School, a certificate of completion will be granted. This certificate does not entitle the bearer to teach any subject they do not have a relevant industry recognised qualification in.
Price of Courses
All course prices are correct at the time of publishing. Air Control Pilates reserve the right to change these prices at any given time.
Revisions
The content of the courses within Ground School are correct at the time of publishing. Air Control Pilates reserves the right to amend, update or change this information at any time.
Refunds and Cancellations
As these courses are online, and access is available immediately after payment is made, no refunds are available after purchase.
Limited Licence
This online learning platform and all the materials available within are the property of Air Control Pilates and are protected by copyright, trademark, and other intellectual property laws. The online learning platform is provided solely for your personal noncommercial use. You may not use the online learning platform or the materials available within in a manner that constitutes an infringement of our rights or that has not been authorised by Air Control Pilates. You are not permitted to modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the online learning platform. Any learner found to be in breach of these licence use terms will have their access to the online platform revoked and fined £10,000 to cover losses from the theft of intellectual property.

Limited Liability
In no event will either party be liable for any special, indirect, incidental, or consequential damages nor loss of data, profits or revenue, cost of capital, or downtime costs, nor for any exemplary or punitive damages, arising from any claim or action, incidental or collateral to, or directly or indirectly related to or in any way connected with, the subject matter of the agreement, whether such damages are based on contract, tort, statute, implied duties or obligations, or other legal theory, even if advised of the possibility of such damages
DMCA
The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under the U.S. copyright law. If you believe in good faith that materials hosted by Air Control Pilates infringe your copyright, you, or your agent may send to Company a notice requesting that the material be removed or access to it be blocked. Any notification by a copyright owner or a person authorised to act on its behalf that fails to comply with requirements of the DMCA shall not be considered sufficient notice and shall not be deemed to confer upon Company actual knowledge of facts or circumstances from which infringing material or acts are evident. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send to Company a counter-notice. All notices and counter notices must meet the then current statutory requirements imposed by the DMCA; see http://www.loc.gov/copyright for details. Governing Law
Any claim relating to the online learning platform shall be governed by the laws of Scottish Courts, Air Control Pilates’ home jurisdiction, without regard to its conflict of law provisions.

Appendix 1
Air Control Pilates strongly recommends that you consult with your GP/Physiotherapist before beginning any exercise program. You should be in good physical condition and be able to participate in the exercise. Air Control Pilates is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.
You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge Air Control Pilates from any and all claims or causes of action, known or unknown, arising out of Air Control Pilates online classes.
